General.

These Terms of Use constitute the basis for a binding legal agreement between you and Voulue ("Voulue," "we," "us," and "our"). Please read our terms and conditions carefully as they affect your rights and liabilities under the law.

These Terms of Use govern your use of the website www. Voulue.com (the "Site") and the Voulue service and hire and/or sale of products (the "Service"). By using the Service or visiting or viewing the Site, you accept

Terms of Use. If you do not agree to these Terms of Use you should not use the Service, or visit or browse the Voulue website at all.

Voulue have the right to  conduct a credit report on members.

Refundable deposit  may be required; depending on account history and circumstances.

Changes to Terms of Use.

We reserve the right to modify these terms and conditions of use at any time and in any manner which are at the discretion of the owners of Voulue and members of staff who are authorised to do so. Notice of any modification of these terms and conditions of use will be posted as a news post at the top of this website; any modifications will be effective upon the posting of any notice. Your continued use of the website constitutes your binding acceptance of such modifications until your membership is formally removed. Please check this section of the website carefully before using the website to determine whether a change has been made to these Terms and conditions of use.

Changes of these Terms and conditions:  if you wish not to upheld any new additions, you may arrange to terminate your registration and membership with Voulue please notifying Voulue of your intention not to accept the changes to the Terms and conditions of use and service (by emailing enquiries@ Voulue.com, writing to our office at: 13 Holly Close, Tamworth, Staffordshire B79 8QT or call the helpline number 08453920139) and of your intention to discontinue your use of the Voulue service. You agree that we shall not be liable to you or to any third party for any modification of the Terms of Use.

New Member and Obtaining an Account.

To use our Service, you must register and sign up as a member through our website or at our personal events with our agents and obtain a trading account
with Voulue.

 

Voulue require all these details for there records and are needed to obtain an account with Voulue. Our agents will collect copies from you the customer prior to an account being opened. Scanning facilities will be made available.

Your application must be acceptable to Voulue in all respects.

You must have authorised Voulue to process a charge or charges to your credit or debit card in the amount of any initial product rental.

Voulue reserves the right, at its absolute discretion, to refuse membership for any reason. Voulue will not be liable to any person by reason of refusing to process or suspending a membership application.

 

Voulue only conducts business within the UK.

3) Each handbag has a price relative to its age, popularity and cost.

5) If the bag is stained or damaged we will charge you for the cleaning and repair and an administrative cost of £40 (at the discretion of Voulue).

Voulue only cancels membership and agreements, when all hired products and monies owed to Voulue have been paid.


Voulue Shipping service:

The Service allows registered members to access the website and  borrow  or purchase  products from Voulue in accordance with these Terms of Use. Your  identification will be confirmed via our third party varification system, the member can choose to order products from our on-line store or order by telephone, and have them shipped to the member's address.

However, we reserve the right to limit the number of items that a member may borrow at any time. Multiple product hire may be permitted after you have built up an adequate trading history with Voulue.

Voulue reserves the right to withdraw products  at any time without prior notice.

Full borrowing rates for the Voulue products are detailed on the website. All products will be delivered to members by Royal Mail free of charge inclusive of our packaging. Orders received before 1.00pm (1300hrs) will be dispatched the same day. Full transit insurance for the product up to its replacement fee is also inclusive in the delivery.You will be provided with an address label which covers the subsequent return by you.

Delivery times

(1)Royal Mail Special Delivery should be with you by 13.00hrs the next day after you have ordered.

(1) Delivery address, (please note postage to the highlands and islands may occur extra charges) ensure someone is home to sign for your package. You may have your goods sent to your work address, it is your responsibility to accept the delivery, any loss from the time of a signed delivery will be your responsibility.

(2) Stock availability (availability will be shown on the website, you may reserve a bag in advance for a non-refundable deposit of £10, deductible from your hire charge, variable charges may apply for our more expensive and popular bags).

(3) Please note that during holiday periods, Christmas and New Year there may be a rush on the bags, unfortunately  you may not obtain the desired bag .

(4) Other circumstances impacting delivery by our couriers.

We will use our reasonable endeavours to ensure that the product reaches you within three (3) days of your order being placed, however, Voulue makes no guarantees as to actual delivery time and time for delivery of the products to you shall not be of the essence of your contract with us.

Once your ordered has been passed to a third party carrier, Voulue will send you an email advising you of the delivery details and the estimated time and date of delivery. The risk of loss for items shipped passes to you upon delivery to the carrier.

Each order you place for a product will constitute
a separate contract between you and Voulue on the terms and conditions set out in these Terms of Use. In accordance with the terms of such contracts, you must return all products you hire from Voulue on the date notified to you for return of the products.

The maximum duration for hire of any of our products is three (3) months, a new contract of hire being produced for each month. If you fail to return a product to us by the due date for return notified to you, we reserve the right to charge you for another weeks hire charge until the goods are returned .If the customer does not respond to our correspodence we will treat the product as lost and charge your credit or debit card with the full replacement fee(RP) as indicated on our website plus administration costs.

All Voulue products are authentic designer products, sourced from the named designers and/or their manufacturers. They are provided to you in either new or "like new" condition. If you lose a product or return a product to us in a damaged or dirty condition that exceeds normal wear and tear (as determined by Voulue at its sole discretion) you agree that Voulue may charge your credit or debit card if it wishes with a replacement fee for such product (except to the
extent the loss is covered by insurance you may have purchased). The product replacement fee varies depending on the specifics of each bag. Please see the relevant page of our  website for further details. If we determine, at our sole discretion, that the product returned is capable of repair or restoration to its original condition, we may charge you a lesser amount than the relevant replacement fee to cover the cost of such repair or restoration.


Insurance.
You may wish to purchase insurance through your own independent insurance agent for the time of rental. All products that are hired to you will remain, at all times, the exclusive property of Voulue. On hiring a product from us, you agree that you will not re-sell such products supplied to you by Voulue and/or its agents, nor make them available for hire or otherwise allow any unauthorised or illegal use to occur.

Bag Returns.

When you're ready to return the bag simply pack it in its original packaging and affix the self adhesive label provided to you when the bag was first delivered. Take it to your nearest Post Office. We will send you confirmation of tracking and arrival at Voulue.
PLEASE ENSURE YOU SEAL THE BOX PROPERLY.

You must return all products you hire from Voulue on the date notified to you for return of the products, if they have not been recieved by Voulue within 2 days after the due date , we will levy a months hire charge against your method of payment.This will be refuded in full if it is a result of our carriers with a complimentary gift voucher. In any event, the maximum duration for hire of any of our products will be three (3) months. Use of your own COURIER SERVICE, other than Royal Mail, you will be accountable for the safe return of our goods. If not received by Voulue, you must provide original evidence off postage and forward the documents within three (3) days.

Voulue do not take any responsibility for bag returns by third party couriers chosen by you.


Prices for purchase of any of the Voulue products on the website will vary from product to product. Please see the relevant page of the Site for any such prices and information on how to purchase Voulue products. Voulue reserves the right to change any of the membership, shipping, replacement or other applicable charges at any time, but notices of the changes will be clearly posted on our website and will only take effect three (3) days after the posting of such notice.

You warrant to Voulue that you will provide true, accurate, current and complete information about yourself as prompted by the Site's registration form (such information being the "Registration Data"), and you will maintain and promptly update the Registration Data to keep it, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or we have any reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we may suspend or terminate your account and refuse to offer you any and all current or future use of the Service and the Site.

You are solely responsible for maintaining the confidentiality of your account and any passwords. You are solely responsible for any activity related to your account. If you suspect any unauthorised use of your account, notify us immediately. Please note that if we suspect that there has been, or is likely to be, a breach of security or misuse of the Site, we may require you to change your password or we may suspend your account. In order to provide you with ease of access to your account, we may place a cookie (a small text file) on the computers from which you access the Site. When you revisit the Site, this cookie will enable us to recognize you as the account holder and allow you to more easily access your account.

Order Process.

Once you have placed the order to hire a bag you should be notified by email to the email address you provided confirming the order

When the bag is shipped you should receive another email confirming dispatch; Your hire period starts on the day your bag is shipped. (Text message to phone, or landline will be contacted)

Your bag should arrive THE NEXT WORKING DAY if you do not receive the bag after this time frame of receiving confirmation of dispatch, you must inform us by telephone 08453920139 or email us at admin@ Voulue.com.


An e-mail will be sent to one which was entered in the submission process or which
can be updated via a member once they have joined.

We can accept telephone orders from members and new members but we will need to still agree with the T&C of this agreement.

Rights of Third Parties.

Except as expressly provided for above, nothing in theses Terms of Use confers on any third party any benefits under the provisions of the Contracts (Rights of Third Parties) Act 1999.

Cancellation of Membership.

You may cancel your membership at any time by contacting Voulue by e-mail or by telephoning 08453920139 and providing details of your account.

Once you have given Voulue notice to terminate your membership, you will have seven (7) days from the date of such notification in which to return to Voulue all products that you have hired and pay any outstanding charges for any lost or damaged products.

If you fail to return such product (s) or make such payment within seven (7) days, we reserve the right to charge you with a replacement fee for each of the outstanding products and all outstanding fees will be automatically billed to your credit or debit card without further notice.


Territory

Voulue only deliver our services within the United Kingdom, we do not trade outside of the UK.

Recovery of debts.

Non return of goods to Voulue will be considered as theft and reported to the Police. Voulue will pursue legal action with a claim to your local county court. Voulue are entitled to add the court fee and interest to the amount of the outstanding claim. Following successful court action, any further delay will result in one of the following methods being applied to obtain our monies.

A warrant of execution.

This allows court bailiffs to take goods from your debtor's home or business, although there are safeguards in place and certain goods cannot be taken. After a holding period the goods or assets will be sold at auction. Fees and expenses will be taken from the proceeds and you will be given the remainder.

Attachment of earnings order.

This usually applies to an individual person in employment, but it can apply to private pensions too. The employer is ordered to make deductions from the person's wages or salary.

Third-party debt order.

This is where the court orders a freeze on money held by a person, institution or organisation, which might otherwise be paid to a defendant against whom you have a judgment. Thus the holder is the third party and they will prevent withdrawal of the money until the court decides whether all or part of it should be paid to you.

Charging order.

The court places a 'charge' on the debtor's property; equivalent to the amount you are owed. The property could be a house, stocks or shares, or money. A charging order does not oblige the debtor to sell their property, but if they do, they must pay you before they can take the rest of the proceeds.

Voulue has other options available under UK business law, should the necessity arise.

By signing up for the Service, you warrant to us that this information as provided to us is accurate and complete and you specifically authorise Voulue or its agents to bill your credit or debit card the applicable hire fees, per-item purchase fees, shipping charges, any and all applicable taxes, and any other charges you may incur in connection with your use of the service.

Voulue will charge your credit/debit card on the day it processes your order, whether via an agents order form or via internet payment, or telephone order Voulue will charge your credit or debit card for one months rental.. Other fees will be charged to Voulue reserves the right to charge your credit or debit card as you incur them.

If an error occurs on our part, Voulue will  refunded your debit or credit card in full. Voulue also reserve the right to cancel an order if they are unhappy with any identification provided.

If Voulue does not receive payment from your credit or debit card provider, your details are incomplete or inaccurate or if your credit or debit card expires or is rejected, notwithstanding our right to terminate your membership, you agree to pay all amounts due upon demand. Voulue reserves the right to take all steps necessary to collect amounts due from you, including but not limited to using third party collection agencies to collect such sums (together with the costs of us taking such action). Voulue reserves the right to correct any errors or mistakes that it makes even if it has already requested or received payment.

By applying to become a member of the Site and receive the Service, you expressly authorise us (either acting on our own or through third party agents) to carry out such credit checks as we deem necessary in order to determine whether your credit or debit card has sufficient credit to accept any applicable fees or other costs. In the event that your card does not have sufficient credit, we reserve the right to, at our sole discretion, reject your membership application or, as the case may be, terminate your membership. You further expressly authorise us, where we feel necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time (including but not limited to your credit or debit card number or credit reports) to authenticate your identity, to validate

Invoicing.

When you join as a member you will be required to

your credit or debit card, to obtain an initial credit or debit card authorisation and/or to authorise individual purchase transactions, so far as is necessary for those purposes.

You are solely responsible for any and all fees charged to your credit or debit card by the issuer, bank, or financial institution including, but not limited to, membership, overdraft, insufficient funds, and over the credit limit fees. You will not hold us responsible for banking charges incurred due to payments failing on your credit or debit card. You agree to notify us about any billing problems or discrepancies within 60 days after they first appear on your account statement. If you do not bring them to our attention within 60 days, you agree that you waive your right to dispute such problems or discrepancies.

Without prejudice to any of our other rights under these Terms of Use, we may modify the price, content, or nature of the Service at any time. If we modify any of the foregoing terms, you may terminate your membership. We may provide notice of any such changes by e-mail, or by publishing them on the website.

Replacement fees.

The estimated replacement fee for a handbag from the Voulue is displayed on our website as the RP that is provided from the designers catalogue; in addition further charges may be applied at the discretion of Voulue depending on the  history of the bag's exclusivity and uniqueness and the availability to replace the handbag.

Unless otherwise specified, our website is made available to you for your personal and non-commercial use but subject to our Terms of Use. We reserve the right to refuse orders from businesses that we consider are for commercial or non-domestic purposes. Voulue grants you a limited license to access the Site solely for that purpose of viewing and hiring goods from ourselves. We cannot guarantee that the service of the website will be fault free. If a fault occurs with the website you should report it to us using the contact details shown above and we will attempt to correct the fault as soon as we reasonably can. Your access to the Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.

We will not publish offensive, racist or any material deemed to be unsuitable for publication; Voulue may review and delete any content, in whole or in part.


Submitting information to Voulue, you grant us a perpetual, non-exclusive, fully paid, royalty-free, irrevocable, sublicenseable, worldwide license and right to display, use, perform, reproduce, modify, distribute and create derivative works of the Submission or information submitted in any media, software, or technology of any kind now existing or developed in the future. Voulue will perform credit checks when required on members joining depending on the proofs that are submitted. Voulue may also request a deposit if necessary to obtain an account with Voulue.

All applicable UK taxes are your responsibility. You agree to pay these taxes.

Voulue's failure to act in a particular circumstance does not waive its ability to act with respect to that circumstance or similar circumstances. By using the wesite or the Service, you consent to receiving electronic communications from Voulue. These communications will include notices about your account (e.g., shipping and receiving e-mails and other transactional information) and information concerning or related to the our Service. You agree that any
notice, agreements, disclosure or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing. Voulue is excused for any failure to perform to the extent that its performance is prevented by any reason outside of its control.

Assignment of Rights.

Sales

Voulue accept all major credit cards (VISA, MASTERCARD, SWITCH/ MAESTRO, AMERICAN EXPRESS and DELTA).

Returns of Goods Purchased

In addition to the Distance Selling Regulations, you can return any item within 7 days of receipt for a refund of that item or to exchange it for a different size or colour.(The attatched security labels must be maintained intact)

For returns made outside the Distance Selling Regulations, we will refund the monetary value of the goods returned to us, at the price you purchased them.

Please note that in the interests of hygiene, items marked with a "+" next to the product name cannot be returned, unless they have remained in their original wrapping or are faulty.

In all cases, the items returned must be in their original condition. All goods will be inspected on return.

The goods are your responsibility until they reach our premises.


We recommend you use a postal service that insures you for the value of the goods you are returning. Please send your returned goods to: Voulue.com

We also accept cancelled orders under the Distance Selling Regulations – 

All goods must be received by us in perfect and unused condition within 7 days of receipt for full no quibble refund (excluding our postage costs) – please retain proof ofpostage.

Please note when returning goods our postage and packaging costs will be deducted before the refund is processed.

Certain products may vary slightly, resulting in apparent colour variations as seen in our stores or promotional literature. Therefore, colours depicted should be used only as a guide.

In order to adapt to customer feedback we reserve the right to amend and improve product specifications.

We respect your confidentiality and we will never make your details available to any third party.
